Item Análise da política de concessão de recursos hídricos no município de Manaus(Universidade do Estado do Amazonas, 2016-08-26) Carvalhosa, Wallace Ferreira; Silva Filho, Erivaldo Cavalcanti eThis dissertation is subject to analysis of the privatization of the supply of water resources in the face of the guarantee of fundamental human right to access to water, providing examples both in the global context and the national, performing especially a reflection within the city of Manaus. The Brazil enacted Law 9,433 / 97 within a scenario of privatization and concerns about shortages, quantitative and qualitative water when the water begins to acquire economic value. In fact, the shortage legitimizes the collection of water resources and Brazil attracts the interest of multinational corporations, supported by the World Bank, the International Monetary Fund and the World Trade Organization, which will seeping in providing pickup and delivery services water, in comparison with the fundamental right of access to water, an inalienable right. As methodological procedure divided this work into five chapters. In the first, it contained a discussion of the environmental and economic aspects of water, as its importance, its multiple uses, in addition to the pictures of scarcity, pollution and conflicts over water. The next chapter analyzes the legal aspects of water, bringing the principles applied to the right to water, pointing to the laws applied to water. The third chapter deals with the detailed study of the policy of privatization of water supply services in its global and national context, analyzing the time the water becomes interpreted as a commodity as well as the influence of the World Bank and International Monetary Fund corporative control of water through loans to multinational enterprises in the sector. The fifth chapter deals with the privatization process under the law of the city of Manaus, analyzing the provision of water supplies to large private multinational group services, resulting in a Parliamentary Commission of Inquiry and a public civil action to investigate the irregularities in the process of granting the public service of water supply. However, these settlements have become environmental disasters with high rates of forest clearing, highlighting the difficult relationship between the fundamental right to the environment and the National Agrarian Reform Policy. The present research investigates which the Agrarian Reform model is compatible for the Amazon and how the National Agrarian Reform Policy can contribute to the protection of the environment within the settlement projects of the region. The juridical transversality and interdisciplinarity, observed in Contemporary Agrarian Law, the multifunctionality of agriculture and the environmental function of property point to the prevalence of the right to a healthy environment. Conceptually, Agrarian Reform is not limited to the idea of land distribution, but should have a broad meaning where other public policies related to the agrarian question are included. More than access to land, the Comprehensive Agrarian Reform seeks to ensure the improvement of the general welfare and, consequently, the preservation of the environment. The institution by INCRA of the Environmental Action Plan for the period 2008/2011 and the Program for Prevention, Combat and Alternatives to Illegal Deforestation in Amazonian Settlements (PPCADI-Amazônia), called the Green Settlements Program (PAV), in 2012, with the setting targets and guidelines for combating deforestation in settlement projects, indicate the existence of a model of Agrarian Reform for the Amazon. The chosen research line is the conservation of natural resources and sustainable development, with emphasis on the sub-themes sustainable development and public policies. The scientific method adopted is the inductive; the bibliographical and documentary research; and for the purposes of qualitative research. Por tanto la Constitución Federal de 1988, ha estandarizado no sólo el derecho de acceso a un medio ambiente sano, como se prescribe en el deber de su defensa y protección, especialmente para el Gobierno, también responsable de la preparación y ejecución de las políticas públicas para afectas desarrollo sostenible. Sin embargo, este lastre, algunas acciones públicas están causando o riesgos y daños medio ambientales significativos, cuya degradación a veces puede incluso ser objeto de restauración, como ocurre con la realización de algunas obras de construcción, renovación o extensión decrumprindo el Gobierno su deber de protección del medio ambiente. Junto a este deber, el entorno reglamentario proteccionista higid nos ofrecen instrumentos de actuaciones destinadas a preservar el medio ambiente, tanto de forma preventiva, como forma comisivos. El primero a través del Estudio de Impacto Ambiental Preliminar, el segundo por la Auditoría Ambiental realizada por control externo. El principio de prevención es intrínseca a la Ley del Medio Ambiente, en colaboración con otras disciplinas por el principio de la participación, los esfuerzos de sumas para cumplir con el deber de proteger el medio ambiente imbuido con el Gobierno. The unequal distribution and inadequate use have produced conflicts and put into question the guarantee of this resource for present and future generations. Modify this context and establish agreements between the various uses require institutional arrangements capable of reconciling the various interests and the collective production of solutions, which necessarily passes through the enviromental law, while human science endowed with interdisciplinary capacity to dialogue with other branches of science. In this sense, and in order to contribute to solving this problem, international law were establishing and conferences were held that culminated in producing policy guidelines that guided the Brazilian legislation on water management , in particular, by law 9.433 / 97. Among the water management tools employed by the Brazilian standard the creation the Hydrographic Basin Committees as an expression of the principle of participation and as a legal instrument to assist in the management of water resources programs, being a collegiate body of participation and integration between government , users and society to the decision-making on how to conduct the management of water resources. And here lies the core of the research: the Hydrographic Basin Committees and the challenge of implementation of its statutory duties. Considered that the creation of Hydrographic Basin Committees endowed with institutional strength and financial autonomy to fulfill their duties represent the embryo for the realization of a participatory and efficient water management policy, and converging such a design/ concept to the existing factual context in Amazonas State for the management of its water resources, the theme of this research came. Thus, the timely topic of the dissertation deals with the Water Law, specifically in relation to the challenges for the management of water resources in the State of Amazonas, especially in relation to the Committees of Basin Tarumã-Açu River and the Rio Puraquequara, located around the city of Manaus, from the difficulties encountered in the implementation of their management. Thus, the overall objective of the study is to analyze the challenges to be faced to the Committees as essential instrument for the management of water resources, will fulfill its legal duties in the state of Amazonas, for the construction of proposals from the difficulties encountered in the implementation of their management. The theme was chosen according to the personal perception and history of life of the Master degree student, having his knowledge improved by bibliographic and legislative consultation as well as interviews. Starting with the studies of traditional people and communities as well the traditional seeds, as these groups are the main responsible by the preservation and insertion of the seeds in our lives, and the seeds play a fundamental role in cultural manifestations, mainly of the traditional people and communities, but also in the society in general. Is approached the cultural importance of nature and its presence in the formation of Brazilian cultural heritage, demonstrating that the traditional seeds deserve the same protection as other cultural assets. It is concluded then that these seeds are cultural goods indispensable to the preservation of cultural manifestations of the whole society, and therefore they should be protected by cultural heritage tutorship instruments.Item Direito à desconexão e meio ambiente do trabalho(Universidade do Estado do Amazonas, 2016-03-28) Leite, Karen Rosendo De Almeida; Melo, Sandro Nahmias; Silva Filho, Erivaldo Cavalcanti e; Gomes, Sebastião Marcelice; Melo, Sandro NahmiasEl trabajo tiene como objetivo presentar el impacto que la introducción de las nuevas tecnologías han causado en el ambiente de trabajo, que afecta a una serie de derechos garantizados por la Constitución. Para una mejor comprensión del tema, se tratan inicialmente el medio ambiente y el derecho ambiental, el derecho al desarrollo y el progreso tecnológico, haciendo una visión teórica necesaria para el análisis de la existencia de un derecho de desconectar, el derecho a desconectar del ambiente de trabajo, derecho considerado por el autor como fundamental y necesario a la protección de otros derechos garantizados por el ordenamiento constitucional. Por último, se presentaron propuestas de solución a el aparente conflicto entre el derecho a un medio ambiente equilibrado y el derecho al desarrollo, mientras la introducción de nuevas tecnologías y también se presenta el concepto de daño existencial y contextualizados como daño causado al ambiente de trabajo, con la introducción de las nuevas tecnologias, puede importar este tipo de daño.Item Direito ao reconhecimento das terras ocupadas por quilombolas em Manaus(Universidade do Estado do Amazonas, 2016-08-18) Pontes, Aldrin Bentes; Melo, Sandro Nahmias; Melo, Sandro Nahmias; Silva Filho, Erivaldo Cavalcanti e; Rodrigues, Renan AlbuquerqueThis research Dissertation aims to bring a reflection on the official recognition of the lands occupied by quilombo in the state of Amazonas, but specifically in Manaus, in the Community of the Barranco de São Benedito, located in the district Square January 14, south of the capital area. It should be an analysis of the historical process of those community members who are remnants of slaves, coming mostly from Maranhão. The research will examine the right to collective ownership of the quilombos land, as the art. 68 of the Constitutional Provisions of the Brazilian Constitution ensures that the remaining quilombos who are occupying their lands are recognized definitive ownership, and the state must issue their bonds. The project is based on official documentary sources and oral accounts of the remaining themselves. These reports, which occur in the form of casual conversations, are important, since the documents and literature articles bring the idea that people Quilombos are isolated from society.Item O direito urbanístico como instrumento de defesa ao meio ambiente: a construção de uma sadia qualidade de vida na cidade de Manaus(Universidade do Estado do Amazonas, 2016-06-03) Scheffler, Stéfano Guimarães; Melo, Sandro Nahmias; Melo, Sandro Nahmias; Silva Filho, Erivaldo Cavalcanti e; Dias, Mônica Nazaré PicançoMotivado únicamente por la satisfacción de sus necesidades y, supuestamente, por la búsqueda de una cómoda (pero no necesariamente sana) calidad de vida, la voluntad del hombre sobresale ya hace algunos siglos: deforestación, contaminación de aguas, calentamiento global, descubrimiento de la energía eléctrica, quema de combustibles fósiles, el acto de pavimentar y asfaltar las calles, construcciones en mampostería, terraplén de cuerpos de agua, desecho inadecuado de residuos sólidos, experimentos nucleares, entre muchos otros actos que damnifican al medio ambiente, son algunos de los ejemplos dados. El medioambiente, tratado por el hombre como si tuviera infinitos recursos y una interminable capacidad de recuperación, resiste a las embestidas. Se muestra en realidad debilitado, pero todavía existente. Omnipresente, ya demuestra su reacción a los ataques sufridos, lo que provoca que el hombre moderno, consciente de su vulnerabilidad, intente encontrar maneras de buscar una sana y sustentable calidad de vida. Esta tesis presenta como problemática el siguiente cuestionamiento: si la relación del hombre con el medioambiente es inevitable y debe estar guiada por el respeto reciproco, tanto en atención a las necesidades humanas como a los recursos finitos del medioambiente, ¿de qué manera el Derecho Urbanístico puede ser utilizado como herramienta para la construcción de una efectiva y sana calidad de vida? The State of Amazonas through the law n. 3167/07, regulates the State Water Resources Policy and establishes the State System of Management of the State of Amazonas Water Resources. The unbridled drilling and lack of oversight has caused damage which may become irreparable to groundwater in the city of Manaus. The objective of this research is investigate, with the agencies responsible for management (execution / supervision), among others such as: Department of the State of Amazonas Environment, Institute of Environmental Protection of Amazonas (IPAAM), State Council for Water Resources Amazon, the Amazon River Basin Committees, the Water agencies of State of Amazonas , CPRM and the Manaus dealership Environmental, and what is occurring, to carry effectively the law, to equate this omission. Despite the Amazon Cooperation Treaty not having assimilated concepts rooted in International Water Law, such as the definition of basin of international drainage or international river, represents a strong expression of the norms international issues, such as environmental preservation and protection, even ensuring the sovereignty of Amazon States, since this was its main focus. The reasons why the Treaty has privileged sovereignty is in the frequent international discourses that preach the internationalization of the Amazon, under the false premise that the Amazon States, through their governments, would not have the capacity to manage environmental assets, putting the international community, especially in the future maintenance of these assets. The insistence on expropriation of Amazonian assets, which result from their enormous dimensions and fantastic riches of all shades have always been a constant in the Amazonian reality, since the first explorations by colonizers, which is evaluated in the text, in a separate chapter on the Amazon. The text evaluates the environmental issue, from the perspective that it represents a change in paradigm in Law; demonstrates the growing concern of countries with the availability and water quality, which has generated international cross-border conflicts; reports the terms the construction of the Amazon Cooperation Treaty and the difficulties in its implementation; It is, as a conclusion, it evaluates the importance of the norms of International Water Law in the Treaty of Amazon Cooperation, and the strong contribution of the terms of the Treaty in Law Water International.Item Os Kokamas e os desafios de acesso aos direitos fundamentais no alto Solimões(Universidade do Estado do Amazonas, 2023-02-14) Feitoza, Diego Amorim; Silva Filho, Erivaldo Cavalcanti eThe contact with modern society made possible great improvements in the social, cultural and material organization of the Kokama ethnic group. In successes, mistakes, challenges and perspectives in relation to the rights that are constitutionally guaranteed to them.Item A lei pro-águas como ferramenta de implementação de sistema de tratamento de esgoto em condomínios residenciais de Manaus(Universidade do Estado do Amazonas, 2024-04-17) Breves, Luciana de Souza; Silva Filho, Erivaldo Cavalcanti e; Vieira, Guilherme Henrich Benek; Silva, Túlio Macedo Rosa eThe study, developed based on bibliographical research, uses the deductive-descriptive method, with the main objective of analyzing Municipal Law 1,192/2007 (Pro-Águas) as an environmental tool for adapting the sewage treatment system of construction projects. Manaus built before the law came into force, which would, in theory, include residential condominiums in an urban area that circulate more than 40 people per day. The article develops with a historical-philosophical excursion into the nature-man relationship, in order to contextualize the research, mainly within an Amazonian panorama, and understand the reasons why today it is necessary to think about ways to realign this relationship between human beings and nature, through the idea ofan ecologically balanced environment, already constitutionalized in the Brazilian legal system as a fundamental right. Next, the concept of sustainable development and its relationship with basic sanitation are discussed; with the urban development policy and fixation of municipal competence; and with the legislative history of the Public Basic Sanitation Policy in Brazil, relating them, finally, to the Pro-Water Law. Finally, we sought to criticize the mandatory installation of a sewage treatment system in residential condominiums built before legal validity (and already having another type of sanitary sewage approved at the time of their construction), without the law municipality has addressed well-defined legal categories and hypotheses, nor enforceable deadlines, reflecting, therefore, whether Pró-Águas is an effective and sufficient tool to achieve, in practice, the intended environmental objectives.Item Meio ambiente Citadino e participação popular(Universidade do Estado do Amazonas, 2012-06-22) Mendes Júnior, José Rogério de Sousa; Saleme, Edson Ricardo; Saleme, Edson Ricardo; Fonseca, Ozorio José de Menezes; Silva Filho, Erivaldo Cavalcanti eEste trabajo busca tratar de los temas jurídicos del derecho a la participación popular en la gestión ambiental del Municipio. El espacio urbano debe cumplir una dinámica propia cuando el tema es medio ambiente. De este modo, es garantizado a los municipios el aparato jurídico y administrativo propio para la realización de su misión ambiental constitucional. El Estatuto de la Ciudad (Ley n. 10.257/01) ha permitido que el orden público y el interés social fueran regulados bajo el amparo de la función social de la propiedad, de la seguridad, del bienestar del ciudadano y del medio ambiente equilibrado. Así, se congregan los esfuerzos en el alcance de una gestión democrática en ciudades sostenibles, especificando directivas políticas y ambientales y fomentando instrumentos en su amparo en este sentido. El derecho a la participación subsidiaria, la gestión de los problemas cotidianos de las ciudades por medio de la implementación de valores no apenas democráticos, pero también de valores ecológicos. El principio de la participación, de otro modo, como cualquier otro instrumento gestionado por la mano de los administradores permite, por cuenta de la propia administración, ajustar su utilización a cada situación específica. Desde esta premisa, necesario se hace dibujar a los perfiles jurídicos del instituto como herramienta de participación ciudadana en las políticas públicas de sostenibilidad, detallando sus particularidades y distingüendo su aplicación con una necesaria entonación crítica y dialéctica. De esta manera, se busca establecer a las aplicaciones posibles de este instituto, de modo a explorar el máximo posible su versatilidad sin que se comprometa su naturaleza jurídica o se intervenga, o se deje de intervenir, inadecuadamente por la esfera subjetiva de terceros. The place where the penalties are met must also respect the constitutional and legal dictates relevant to the appropriate conditions of enterprises, public or private, established through the environmental licensing. The lack of adequate conditions for the serving of sentences did not arise in our times, but has been perpetuated in Brazil since 1500, with its discovery, and other countries even more remotely. The struggle for recognition and respect for human rights is not new, being an evolutionary process that has been adding new rights to its role throughout the history of civilizations, including the recognition of the environment as a right of third generation. The evolution of the Brazilian criminal law also has gone through transformations under the historical references of lived time, reflecting changes in "darkness" with degrading and corporal punishment, to the "lights" with the humanization of feathers. The story Amazonas State of the prison system highlights the precarious conditions of their environment prison environment, from its initial installations to date. For the defense of the prison environment, only in this case can the interpreter of the law find what fundamental right should prevail over another. Detailing to the current environmental conditions of prisons IPAT and UPP, it is clear how these are impacting detrimentally on the health of prisoners, staff and community correctional facility adjacent. It highlights the need for awareness and adoption of measures to ensure a healthy life for all, including people deprived of liberty. In the Brazilian context, serving a sentence aims to reintegrate the individual into society. However, the problems faced by the prison system, such as rebellions, overcrowding and criminal recidivism, show that many detainees leave prison with the same deficiencies that led them to crime, perpetuating a cycle of entry and exit from prison institutions. In Brazil, there are different types of penal establishments. It should be noted that Penitentiaries are establishments intended for the fulfillment of custodial sentences in a closed regime. It should be noted that in Manaus there are only 2 (two) establishments that house prisoners in a closed regime, namely: AnísioJobim Penitentiary Complex (COMPAJ) and Antônio Trindade Penal Institute (IPAT), which will be the object of study. Both face significant challenges, such as overcrowding, and were the scene of major massacres in 2017 and 2019. In view of the deficiencies in the prison system, it is questioned whether the balanced environment and the quality of life of people deprived of liberty are effectively guaranteed in COMPAJ and on IPAT. To answer this question, a study will be carried out that includes a bibliographic review, document analysis, reports of professional experience and a case study. The research seeks to analyze whether the State offers mechanisms to guarantee a healthy life for people deprived of liberty in the aforementioned Manaus penitentiaries. Using a qualitative approach and adopting the hypothetical-deductive method, the study will build hypotheses and seek answers to the investigated problem. In addition, theoretical foundations on human rights, the environment, the prison system and serving sentences will be presented. The objective of this study is to propose improvements and contribute to reflection on the subject, both in the legal field and in society in general.Item Mulheres e crimes: um diálogo com os direitos humanos das detentas em Manaus(Universidade do Estado do Amazonas, 2017-12-14) Lima, Neuton Alves De; Silva Filho, Erivaldo Cavalcanti eThis research seeks to understand in this research the multifaceted universe of women involved in crimes that encounter private freedom in the Center for the Provisional Detention of Women in Manaus and in the Anísio Jobim Penitentiary Complex. With support for women's doctrine and feminist criminology, the motives that move these women to the world of crime are discussed. Based on the prison studies approach, it makes an inroads into the main causes of violence and points out which groups of people become the preferred targets of the policy of mass incarceration adopted as a means of containing violence. We also identify the main characteristics of the sociodemographic and economic profile of detainees, through graphs and maps elaborated from the official data of the prison administration. To achieve this objective, the methodology of the deductive method was used, which starts from theories and general laws to reach the particular and presents a structure of thought that allows the validation of already existing information. The research was bibliographic, based on existing documents on the subject, such as books, legal sources and published scientific articles, as well as documentary research, using official documents and statistics. As for the purposes, the research was qualitative. It was concluded that the land for indigenous peoples covers a whole sphere that transcends the physical space, being fundamental for their dignity, for their physical and cultural reproduction, for the maintenance of their way of life, maintenance of knowledge and cultural expressions. The demarcation of indigenous lands and prior consultation are crucial measures to enforce the legitimacy of indigenous peoples' right to territory and their self-determination.
