The Productive Diversion Theory of the Consumer appears, then, with the proposal of a just compensation to the consumer in the face of violations of their rights, including the freedom to enjoy their time. Per On the other hand, the materialization of the Theory still encounters some challenges in the legal field, in particular as to the justification of the compensation due due to the loss of time, seen as a mere annoyance, be framed as damage that can be repaired.
