The present study objectived to discuss the right of collectors of recyclable and reusable material to the healthy and balanced work environment, as established by Articles 200, VIII, and 225 of the Constitution, and the responsibility of the municipal public manager for the realization of this right and for the guarantee of minimum working conditions for this professional category, which performs activity of great social and environmental relevance, public nature and whose operationalization is attributed, at the constitutional (Articles 30 and 145) and infraconstitutional level (Federal Law 12.305/2010), to the Local Government. The methodological approach adopted in this research is the deductive one, considering that analysis of the work environment was elaborated as aspect of the general environment and as fundamental right of individual and diffuse character to then suggest the extension of this fundamental guarantee to the category of collectors of recyclable and reusable material. The study was developed from bibliographical and documentary research, having as parameters national and international books, scientific studies and national and foreign normative texts.
