| dc.description | O presente trabalho tem como objetivo precípuo estudar as alterações relacionadas com o advento da Lei nº 13.146/2015 e a teoria das incapacidades estruturada no Código Civil de 2002. Isso trouxe grande contribuição para propagar a ideia da necessidade de se normatizar os direitos da pessoa com deficiência, desencadeando em um avanço significativo de seus direitos no âmbito do ordenamento jurídico brasileiro. Assim, realiza-se a pesquisa referente às inovações jurídicas trazidas pelo novo diploma legal, quais sejam os institutos da curatela, interdição, a tomada de decisão apoiada e o casamento, concluindo-se que a evolução desses institutos, dado as suas novas características, resultam na facilitação de se externalizar a vontade das pessoas consideradas deficientes. O novo ordenamento reconhece que a pessoa com deficiência é um sujeito de direitos como qualquer outro, devendo o Estado construir mecanismos para que seus direitos adscritos no Estatuto sejam efetivados, tornando este diploma legal eficaz perante a sociedade. | pt_BR |
| dc.description.abstract | The present study aims to identify the importance of the changes related to the advent of Law 13.146/2015 and the theory of structured disabilities in the Civil Code of 2002. Such changes have brought great contribution to spread the idea of the need to regulate the rights of the disabled person, triggering a significant advance of their rights under the Brazilian legal system. Thus, the research on the legal innovations brought by the new legal diploma are held, what are the institutes for curatorship, interdiction, decision making supported and marriage, concluding that the evolution of institutions, given as its new features, resulted in the facility to externalize the will of the people considered disabled. The new law recognizes that a person with disabilities is a subject of rights like any other, and the state must build mechanisms so that its rights under the statute are effective, making this legal diploma effective in society. | pt_BR |
