Resumo

This monograph has as its object the study of the binding effectiveness of the list of article 927 of the Civil Procedure Code of 2015. For such, from a broad bibliographic research, it approaches a study, using the techniques of Comparative Law, of different orders. Western law adopters of the civil law and common law legal families. Based on these notions, we analyze the advent of the precedent system in the Brazilian procedural order, more specifically after the advent of the New Code of Civil Procedure in 2015, giving a brief explanation about the General Theory of Precedents. Finally, we conclude this research by discussing the doctrinal and jurisprudential controversy still present in Brazilian Law, regarding the binding effectiveness (or not) of the list of article 927 of the NCPC, making considerations regarding the procedures adopted by the Superior Courts.
