Resumo
Obstetric violence is a relevant public health problem that must be
eradicated from society. In addition to obstetric violence, Covid-19 emerged, globally,
as another extremely important issue. Identifying the fundamental rights of
women, with regard to motherhood, and understanding the pertinence of the subject
humanization of childbirth and birth it was noticed that some of these rights were relativized,
during the Covid-19 pandemic, and in certain cases, the right was completely
ignored by hospitals and even health professionals. Therefore, from the observation of the
position of the Brazilian legal system, through laws, jurisprudence and literature,
it was possible to observe, from the study of civil liability, how the aggressors
of the cases that occurred can be held accountable.
