| dc.description | O foro por prerrogativa de função tem previsão legal na Constituição Federal de 1988. É a Carta Magna brasileira que atribui competência ao Supremo Tribunal Federal para processar e julgar o Presidente da República, o Vice-Presidente, os membros do Congresso Nacional, os Ministros do STF, além do Procurador-Geral da República, nos termos do art. 102, inc. I, “b” do texto constitucional. Entretanto, nos últimos anos, o Brasil enfrenta uma crise política cujas investigações policiais apontam para um dos maiores escândalos de corrupção da história do país. Neste contexto, objetiva-se investigar se o foro por prerrogativa de função transformou-se em privilégio a serviço da impunidade. | pt_BR |
| dc.description.abstract | The privileged jurisdiction has legal preview in the Brazilian constitution of 1988. It’s the Brazilian magnum letter that delegates competence to the Federal Supreme Court to process and judge the President of the Republic, the Vice-President, the members of the National Congress, the Ministers of the FSC (STF) and the brazilian Attorney General, by the terms of article 102, I, “b” of the constitutional text. However, in the last years, Brazil faces a political crisis which police’s investigations leads to one of the biggests corruption scandals of the country’s history. In this context, we have to analyze if the privileged jurisdiction, became into a privilege at the service of impunity. | pt_BR |
