Estruturação político-legal da formação na modalidade de residência em saúde no Brasil

Abstract

To identify and systematize the political-normative provisions of the structuring of

training in the health residency modality in Brazil. Method: Documentary research on political- normative provisions, conducted between September and October 2025. Data sources were the

official websites of the regulatory bodies of health training in Brazil. For data analysis, the qualitative technique of content analysis was applied. Results: The study included 41 publications, consisting of 2 laws, 16 ordinances, and 23 resolutions. Law No. 11,129/2005 established Residency in the Professional Area of Health as a lato sensu postgraduate program in Brazil, created the National Commission for Multiprofessional Health Residency, and instituted the Scholarship Program as a financial incentive component of the National Program for Youth Inclusion, being amended by Law 12,513/2011, which established the National Program for Access to Technical Education and Employment. From 2005 onwards, ordinances were ratified. Interministerial committees to regulate the 2005 laws. Between 2010 and 2024, following the establishment of the National Commission for Multiprofessional Health Residency, resolutions were issued aimed at regulating the organization and functioning of Health Residency Programs in the country. Conclusion: The political-legal structuring of training in the residency modality has been organized and regulated by legal and normative instruments that demonstrate a commitment to qualifying health professionals to meet the needs of the Unified Health System.
