Conflitos socioambientais e ocupações urbanas: análise legística do programa Amazonas Meu Lar

Abstract

This study aims to analyze the Fundamental Right to Habitation in the face of the Right to an Ecologically Balanced Environment, analyzing the failure of the State in relation to public policies, education and environmental information. It turns out that the Right to Habitation is closely linked to Environmental Law, because the high concentration of income and the swelling of the cities in Brazil, caused an increasing of unworthy and unhealthy housing, that were out of balance with the environment. Finally, it is understandable that the collective, along with the State, is responsible for the preservation of the environment, and the State have the duty to protect it through legislation, public policies and environmental education. The methodology used in this work is the bibliographical, qualitative, with consultation with the legislation and doctrine
