Resumo

This monograph intends to understand, from the perspective of the Direct Action of Unconstitutionality (ADI) No. 5.508 / DF, the interpretation of the Federal Supreme Court (STF) about the legitimacy of using the institute of award-winning collaboration through the role of police in criminal investigation. Once award-winning collaboration comes gaining greater visibility, see cases in the media such as Operation Car Wash, how it should be applied and the extent to which it is legitimized becomes questionable by those who practice it as a means of obtaining evidence. The objectives of this brief study identify who is responsible for conducting and establishing the award-winning collaboration as per legal dictates; identify, from the perspective of the Ministers what is the police delegate's role in investigating and which differs from the Public Prosecution Service (MP); and recognize other aspects of the institute award-winning collaboration addressed by Ministers and other parties in their votes and opinions. For this, a descriptive research was conducted, based on both reading and as for the transcription of the votes cast by the Ministers in ADI No. 5.508 / DF. As As a result, it has been found that while the Court still has a long way to go in definition of important questions about award-winning collaboration, it is already possible to glimpse some positions about the subject studied here.
