Resumo

This study addresses a proposed legislative amendment to Laws No. 4,044 of June 9, 2014, and No. 1,116 of April 18, 1974, regulating the periodic performance of toxicological tests for military personnel of the Amazonas Military Fire Department (CBMAM). The research analyzes technical, constitutional, and infraconstitutional aspects related to the test, in addition to assessing its relevance for occupational health, institutional discipline, and operational safety. The results indicate that the practice of periodic tests is effective in preventing risks, detecting drug addiction early, and preserving the institutional image. A regulatory gap is observed in Amazonas, while states such as Ceará and Espírito Santo have adopted similar regulations through stricto sensu laws, demonstrating legal and institutional viability. The study concludes that the implementation of periodic examinations, based on objective criteria, transparency and confidentiality, becomes compatible with the constitutional principles of legality, morality, efficiency, public interest, intimacy and privacy, offering benefits to the corporation, the military and society.
