Item Proteção à vítima e à prova testemunhal: eficácia jurídica contra a impunidade(Universidade do Estado do Amazonas, 2014-11-04) Morais, Maiza Helena Rodrigues; Rebelo, Luiza Maria BessaThe aim of the present research is to analyze the performance of the protection program to endangered victim and witness – PROVITA/ Amazonas, considering its juridical efficiency in State of Amazonas, in the period between the years 2012 and 2013. So it was analyzed the data enclosed in the Work Plan of each one of the specified years, as well the recorded results in the Object Fulfillment report. The PROVITA sprang from civil society’s movements and group experiences that thought in this kind of protection strategy to combat the impunity and effectively collaborate with the pursuit for justice. From this movement the Federal Law 9.807/99 was created, which institutes the program and its guidelines. This foundation originated the state legislation and the rest of practices that today are added to the actions that seek the real condemnation of the accused people in those processes which exist the protected witnesses/victim participation, offering to this public all the necessary structure to have the conditions to effectively contribute with their testimonies. This protection politic fits with the public security politic which charted guidelines in its national plan to improve and potentize these actions faced to endangered victims and witnesses. The methodology used was the documentary and bibliographic research, and a sample interview to validate the data.From the colected data, the technical-didactics limitation of the reasearched documents, as they have limited content and few objective, what embrass a more qualified analysis. Notwithstanding, it can be concluded that the Protection Program is effective in case of attend, in its majority, the emphasized criterions in the work plan, leaving gaps in the aspects related to procedural analysis, considering the work plan data come forward insufficient for this discussionItem Policial bom é policial vivo: um diagnóstico em saúde do trabalhador na polícia civil do Amazonas(Universidade do Estado do Amazonas, 2014-10-12) Lima, Paulo Afonso Sampaio De; Leite, Iuri CostaThe police profession is one of the most strenuous, causing a huge burden of disease, with physical and psychological consequences. The objective of the study was to understand the main causes of disease that cause absenteeism of police officers of the Amazon and its possible relations with the working conditions, through the Permits Health Care, between January and December 2012. The diseases classified form into three major subgroups of group 22 and diseases conforms proposed by Murray and Lopes disease burden studies. The results show that the three main groups of diseases in the studied population, representing almost 40% of all diseases recorded were: psychiatric disorders (14.4%), musculoskeletal diseases (13.5%) and cardiovascular disease (10 , 3%). Regarding psychiatric illnesses women had rates 100% higher than that of men. Servers with over 15 years of service had an incidence higher rates. Delegates had higher and statistically significant rates compared to the researchers. Among the psychiatric, major illness was depression, with 30.8% of cases, followed by post-traumatic stress disorder, panic disorder and bipolar disorder. In musculoskeletal diseases: sex, position and length of service, also showed similar effects. These were statistically significant only for professionals with less than five years of service. In relation to musculoskeletal disorders noteworthy LBP representing almost 40% of all cases. Among cardiovascular diseases observed lower rates between the upper reaches of servers. The higher the age and length of service, the greater the chance of occurrence of cardiovascular diseases. Hypertensive disease was more prevalent among cardiovascular diseases, with 43% of cases. The survey results point to the need for expansion and stock offerings aimed at comprehensive care in health police server to ensure a better quality of life.Item Análise da influência do tráfico de drogas nos homicídios dolosos em Manaus(Universidade do Estado do Amazonas, 2014-11-15) Moreira, Emília Ferraz Carvalho; Nascimento, Antônio Gelson de OliveiraThe “Analysis of the drug traffic influence over the homicides in Manaus” consists in a study proposal that intends generally to analyze the possible relations between the drug Market and the lethal violence in local scenery. To reach this goal, it was necessary to comprehend the peculiarities of the drug traffic in the region and also the dynamics of the criminal network that prevail in the city. Empirically, to verify the possible relation between drugs and violent deaths in Manaus, police Inquiries of the Homicide and Kidnaping Special Police Department that investigate the murders in 2013 were analyzed. The methodology used consisted in a vast bibliographic revision, in a study of legal procedures established to disfavor the criminal, local, faction members and the collect and analyses of the data over homicides in Manaus. The study conclusion reveal the existence of a complex criminal network at work in the State, with the direct incidence on the region’s homicides, since 40% of the l investigative reports indicate the involvement of the parties with drug traffic. Of this total the main victims are male (97%) and young people between 14 and 34 years of age. The study also concluded that the quantity of apprehension by drug traffic have influenced the homicide rate between 2007 to 2013.Item O preconceito como fator de violência: um estudo de caso dos paraenses em Manaus(Universidade do Estado do Amazonas, 2016-10-15) Tamer, Alexandre dos Santos; Marques, Dorli João CarlosThe current study analyzed the relationship between the criminal indicators of the city of Manaus, specifically robbery, theft, homicide and murder after robbery, from March / 2012 to July / 2016, with the number of Paraenses responsible for these indices, thus deconstructing regional prejudice against the Paraense migrants, since it was found that the perpetrators of these crimes were, for the most part, Amazons. The inductive method was used, and interviews, bibliographical and field research were done, enabling a consistent analysis of the data surveyed. Regarding the purposes the research was characterized as qualitative-quantitativeItem O direito à segurança pública e os indígenas Ticuna do alto Solimões(Universidade do Estado do Amazonas, 2016-11-30) Peña, Sofia Caroline De Castro Souza; Wiggers, RaquelThis study aimed at revealing the existence of repressed demand for public security in the indigenous communities located at Alto Solimões, Belém do Solimões, and Umariaçu I and II regions, in Tabatinga (in the state of Amazonas). In order to conduct the task, we applied the method of Exploratory Research through documental and bibliographical research, based on public documents, such as reports (of institutional meetings, public meetings, interviews with indigenous representatives), administrative procedures, lawsuits and bibliographic material. There is a hint of violent situations that often do not reach the police because of language, geographical and cultural barriers, and are thus sub-registered. The filed visits happened in the Project of Indigenous Participative Census (JanuaryMarch/2014 – School of Social Studies/UFAM), when the researcher participated in the project of Communities Umariaçu I and II; as a board president of General Elections/2014 (October/2014 – TRE/AM), in the Community of Belém do Solimões; and in Public Meetings in Belém do Solimões, as an advisor of the Federal Public Ministry. The collected documentary data allowed us to determine that the effort of the State is based on combating drug traffic and smuggling. This reveals the difficulties to implement public security in the region, due to the lack of workforce, besides the Amazonian dimensions. The sporadic operations carried out through institutional cooperation violate the right to public security of rural communities, which is latent and requires everyday actions from the community. We also aimed to understand that the State choking the indigenous initiatives to guarantee their public security is goes against the diversity recognition. Brazil is not only incapable of accepting solutions for the violence problems embodied in the Indigenous Police of Alto Solimões, in Tabatinga, or the indigenous guard of Dourados (in the state of Mato Grosso do Sul), but it also relegates these citizens to a level of undercitizenship, by forbidding their access to a decent life through ensuring public security in their communities. By way of suggesting a model that is capable of respecting the diversity, we list the strategy of the “guardia indígena” from the North Cauca, in Colombia, biased by ensuring citizen participation and appropriating the pact of Convention 169; it has the freedom to exist, act and ensure respect within their own nation state.Item O devido processo legal nas sindicâncias instauradas no âmbito do corpo de bombeiros militar do estado do Amazonas(Universidade do Estado do Amazonas, 2016-11-03) Belota, Kathleen Souza De Oliveira; Nascimento, Izaura RodriguesWith the advent of the Federal Constitution of 1988, the rights and individual warranties were exalted, conquering space, at least in legal devices and, consequently, the whole society became thirsty for glimpsing the materialization of those rights and warranties, including the military ones, which undergo specific laws, however they should not be released of the principles that govern the Human Rights, expressed not only in the Federal Constitution as also in the Universal Declaration of the Human Rights, particularly with respect to the equality principles among all the human beings.In that sense, the Federal Constitution, in its art. 5th, LV, assures the accused and the litigants in general, in lawsuit or administrative, the right to the wide defense and to the contradictory, with all the inherent resources to it and in the same pattern it is pronounced in Art. 3rd, §9th of the Constitution of the Amazon State. The research looked for consisted in checking if, as occours in other military institutions exposed during the work, the inquiries established in the Military Fire brigade of the State of Amazon, contemplated the wide defense and the contradictory, as well as the production of the means of proofs, and if the filings flowed from the disrespect to such essential procedural presuppositions, for the simple fact that the investigator doesn’t assist to those essential requirements, or if, in fact, it is permeated by a corporatism, inclusive in what refers to the post or military graduation, disrespecting one of the basic principles of the Human Rights: the dignity of the human being. An analysis of the inquiries established in the period from june/2012 to june/2014, combined with the application of 32 questionnaires and 20 interviews with military firemen made possible to hear some of them concerning the historical construction of the institution, this perceptions and existences concerning their rights when they represented as investigated, as well as the perception and difficulties found by the investigator in the execution of the procedural rite and time. The results demonstrated that half of the inquiries didn't assist to the principle of the contradictory and wide defense; that most of the inquiries were concluded by the investigator in the established time, but the solution delivered by the judging authority was presented out of the established time, giving rise in late punishments or in delay in the same filing even in face of situations in that there weren’t indications of functional irregularity. The study revealed revealed the need to review the instruments used in the establishment and solution of inquiries.Item Tráfico de entorpecentes na Amazônia: identificando caminhos e rotas vulneráveis(Universidade do Estado do Amazonas, 2014-10-05) Rodrigues, Umberto Ramos; Nascimento, Antônio Gelson de OliveiraThis work has the objective to promote a thorough analysis of the main routes and modus operandi of the criminal organizations operating in international drug trafficking in the Amazon, as well as carry out an analysis of the confronting drug trafficking in Brazil, especially cocaine model. The unfolding of this research is guided in four focal points: a) the permanence of the illegality of the drug trade illegal substances; b) decriminalizing the use and possession of drugs for personal use; c) control of production and distribution of chemical precursors of narcotic substances; d) definition of routes and profile of individuals caught in the act of drug trafficking in the Amazon in the years 2011-2013.Item Tráfico de cocaína na cidade de Manaus: condições socioeconômicas e encarceramento(Universidade do Estado do Amazonas, 2014-09-17) Agra, Miguel Jaime Dos Santos; Silveira, Edson DamasThe aim is to study the relationship between crime and socioeconomic variables of the agents jailed for cocaine trafficking in the city of Manaus. Variables were raised in interviews with defendants and consultation to criminal proceedings in the course of the hearings and trial conducted in the 3rd Specialized Court for Crimes of Use and Trafficking of Narcotics during the period between May 2012 and January 2013. The statistical test used is called the Fisher exact test non-parametric, allowing the realization of crosses between categorical variables at a confidence level of 95% and a 5% significance accordingly. The hypotheses were defined two: (a) the proportions of a subject to a level of the other variable are equal, i.e., there is no influence of one over the other; (b) the proportions of a subject to a variable level are different from each other, ie, there is an influence over the other. The work is descriptive in nature and methodology developed from the theoretical framework of Alessandro Baratta (2002) grounded in critical criminology are examined in which the paradigms of cocaine trafficking and imprisonment.Item Política pública de segurança: avaliação do programa ronda no bairro(Universidade do Estado do Amazonas, 2014-10-08) Cascaes, Frank Eduardo da Mata; Fioravante, Edwan FernandesThis research aims to evaluate the impact of the program in Ronda no Bairro, from the point of view of crime statistics from the North Zone of Manaus, since its inception in the year 2012.'s. Work also has the following objectives describe the temporality of the implementation of the Programme Ronda no Bairro and the assessment of crimes of theft and robbery in the city of Manaus, more precisely in the north of the city. Therefore, the comparison of the number of occurrences of theft and robbery before and after the implementation of the program was held in the northern zone, because these occurrences are probably the most directly affected by the implementation of the program. Through the Wilcoxon statistical test was possible to conclude with 95% confidence that the program in Ronda no Bairro reduced the number of occurrence of theft in the North Zone of Manaus, with an indication that this reduction was also significant in the rest of the city of Manaus.Item Narcotráfico na tríplice fronteira Amazônica entre Brasil, Peru e Colômbia: características e formas de combate(Universidade do Estado do Amazonas, 2014-10-06) Balieiro, Luiz Felipe de Vasconcelos Dias; Rodrigues, IzauraIn the Upper Amazon, extreme western Amazonas, it is located the Triple Amazon Border, formed by the cities of Tabatinga/Brazil, Santa Rosa/Peru and Leticia/Colombia. This border area is identified as one of the entry points of narcotics produced in Colombia and Peru in the Brazilian territory. Given this context, this research analised the characteristics of drug trafficking in that zone, the existing structure of police forces operating there, as well as the projects of the various tiers of government relating to Public Safety in the region. Thus, it obtained an overview of the brazilian state capacity to prevent and suppress that form of criminality and thus ensure public order and social peace in that strategic area of Brazil.
